1. Acceptance of Terms
Welcome to 1st Alert.
These Terms of Service ("Terms") govern your access to and use of the 1st Alert mobile application ("App"), the official website, and all related services, features, products, premium offerings, and customer support provided by First Alert Health Tech Private Limited ("Company", "we", "our", or "us") (collectively referred to as the "Services").
By creating an account, accessing, or using any part of the Services, you acknowledge that you have read, understood, and agree to be legally bound by these Terms, our Privacy Policy, and any additional policies that may apply to specific features or Services.
If you do not agree with these Terms, you must not access or use the Services.
The Company reserves the right to update or modify these Terms from time to time. Continued use of the Services after any updated Terms become effective constitutes acceptance of the revised Terms, to the extent permitted by applicable law.
2. Definitions
For the purposes of these Terms:
Company
Company means First Alert Health Tech Private Limited, incorporated under the laws of India.
App
App means the mobile application known as 1st Alert, including all future updates and versions released by the Company.
Services
Services means all products and services provided by the Company, including but not limited to:
Emergency SOS
Live Location Sharing
Emergency Contact Management
Medication Reminder Services
Missed Medication Alerts
Health Vault
Insurance Document Storage
Women's Personal Safety Features
Emergency Conference Calls
Premium Features
Customer Support
Website Services
Future products and services introduced by the Company
User
User, you, or your means any individual who accesses or uses the Services.
Account
An Account means the registered profile created by a User for accessing the Services.
Emergency Contact
An Emergency Contact means a person voluntarily designated by the User to receive emergency alerts, location information, or other emergency communications initiated by the User.
SOS
SOS means the emergency assistance feature within the App that enables Users to notify their selected Emergency Contacts, share emergency information, transmit live location, initiate emergency conference calls, and access other emergency-related Services.
Health Information
Health Information means any medical or health-related information voluntarily provided by the User, including medical conditions, allergies, medications, prescriptions, blood group, insurance information, and other health records stored within the App.
Premium Services
Premium Services means paid subscriptions or additional features made available by the Company.
Content
Content means all text, graphics, logos, software, images, documents, trademarks, designs, databases, and other materials made available through the Services.
3. Eligibility
To use the Services, you must:
Be 18 years of age or older.
Have the legal capacity to enter into a binding agreement under applicable law.
Provide accurate and complete registration information.
Use the Services only for lawful purposes.
The Company may refuse, suspend, or terminate access to the Services if it reasonably believes that a User does not meet these eligibility requirements.
4. Account Registration
To access certain features of the Services, you must create an Account.
During registration, you agree to:
Provide accurate and complete information.
Verify your mobile number through OTP authentication.
Keep your information current and up to date.
Protect your device and authentication credentials.
Notify the Company if you believe your Account has been accessed without authorization.
Each User may maintain only one personal Account unless otherwise authorized by the Company.
You are responsible for all activities conducted through your Account.
The Company may suspend or terminate an Account if:
False or misleading information is provided.
The Services are misused.
Fraudulent activity is detected.
These Terms are violated.
5. Description of Services
1st Alert is designed to help individuals and families prepare for emergencies and manage important health information.
The Services currently include, where applicable:
One Tap SOS activation
Live Location Sharing during an active SOS
Emergency Contact notifications
Emergency Conference Calls
Preferred Ambulance contact support
Medication Reminders
Missed Medication Alerts
Health Vault
Insurance document storage
Women's Personal Safety features
Health Deals & Offers (optional)
Premium Services
Other features introduced by the Company from time to time
The Company may modify, enhance, discontinue, or introduce new features at its discretion.
Certain Services may require:
Internet connectivity
Mobile network availability
GPS access
Device permissions
Premium subscription
Third-party service availability
The Company does not guarantee that every feature will be available at all times, in all locations, or on all devices.
6. User Responsibilities
To help ensure the safe and effective use of the Services, you agree to use the App responsibly and in accordance with these Terms.
You are responsible for:
Providing accurate and up-to-date personal and health information.
Keeping your Emergency Contacts current.
Ensuring that your chosen Emergency Contacts are aware that they may receive emergency notifications from you.
Maintaining the accuracy of your medication schedules and health records.
Keeping your mobile number and account information updated.
Protecting your device and OTP authentication credentials.
Keeping your device adequately charged whenever possible.
Enabling the permissions required for the features you choose to use, such as location, notifications, and microphone access.
Using the Services only for lawful and legitimate purposes.
You acknowledge that inaccurate, incomplete, outdated, or misleading information may reduce the effectiveness of the Services.
The Company is not responsible for any consequences resulting from inaccurate information provided by you.
7. Emergency Services & SOS
1st Alert is designed to help facilitate emergency communication and preparedness by enabling Users to quickly notify their trusted Emergency Contacts and access emergency-related features.
The Company does not operate an ambulance service, hospital, police department, fire department, emergency dispatch center, or any government emergency response agency.
The Services are intended to assist Users in communicating during emergencies and should not be interpreted as a substitute for official emergency services.
User-Initiated Emergency Actions
When you activate an SOS, the App may, depending on your settings and available Services:
Notify your selected Emergency Contacts.
Share your live location.
Initiate emergency conference calls.
Notify your preferred ambulance contact.
Share your emergency medical information.
Trigger other emergency communication features offered by the App.
These actions occur only after an SOS is initiated by you or otherwise through features you have expressly enabled.
No Guarantee of Emergency Response
While the Company strives to provide reliable Services, we cannot guarantee:
Ambulance availability or arrival.
Police response.
Hospital admission.
Acceptance of emergency calls.
Delivery of SMS messages.
Delivery of push notifications.
Delivery of voice calls.
Immediate response from Emergency Contacts.
GPS accuracy.
Internet availability.
Mobile network coverage.
Device battery availability.
Continuous operation of third-party communication services.
Emergency outcomes depend upon numerous factors outside the Company's control.
Whenever possible, Users should also contact official emergency services directly.
User Responsibility During Emergencies
Users remain responsible for:
Seeking appropriate medical assistance.
Contacting official emergency services when necessary.
Maintaining accurate Emergency Contact information.
Ensuring required permissions remain enabled.
The Company does not assume responsibility for medical decisions or emergency outcomes.
8. Medication Reminder Services
Medication reminder features are intended solely to assist Users in remembering their prescribed medication schedules.
The Services:
Do not prescribe medications.
Do not diagnose medical conditions.
Do not recommend treatments.
Do not replace healthcare professionals.
Medication reminders are based entirely upon information entered by the User.
The Company is not responsible for:
Incorrect medication schedules entered by Users.
Missed reminders caused by device settings, disabled notifications, battery limitations, operating system restrictions, or connectivity issues.
Any medical consequences arising from missed or delayed medication.
Users should continue to follow the advice of qualified healthcare professionals.
Missed Medication Alerts
Where enabled by the User, the App may notify selected Emergency Contacts when a scheduled medication appears to have been missed.
These notifications are provided as a convenience feature only.
The Company cannot verify whether medication was actually taken and does not guarantee the accuracy of such alerts.
9. Women's Personal Safety Features
The Women's Personal Safety features are designed to assist Users in communicating with trusted Emergency Contacts and, where available, emergency services during situations in which they feel unsafe.
These features may include:
One Tap SOS activation.
Live location sharing.
Emergency conference calls.
Emergency notifications.
Police contact support where configured.
These features are intended to improve communication during emergencies but do not guarantee protection from harm, prevention of criminal activity, or immediate assistance.
Users should always contact local law enforcement or emergency services whenever immediate danger exists.
10. Health Vault
The Health Vault allows Users to securely store important medical information for quick access during emergencies.
Information may include:
Blood group.
Allergies.
Medical conditions.
Medications.
Medical history.
Insurance information.
Prescriptions.
Medical documents.
Users remain solely responsible for:
The accuracy of stored information.
Updating information when circumstances change.
Ensuring uploaded documents remain current.
The Company does not independently verify the accuracy, completeness, or medical validity of any information stored within the Health Vault.
Healthcare providers and emergency responders should independently verify medical information before relying upon it for treatment decisions.
11. Insurance Information & Documents
The App allows Users to store insurance policy information and related documents for convenient access during emergencies.
The Company:
Does not issue insurance policies.
Does not provide insurance advice.
Does not process insurance claims.
Does not guarantee acceptance of any insurance by healthcare providers.
Insurance information is stored solely for the convenience of the User.
Users remain responsible for maintaining valid insurance coverage and ensuring that stored documents remain accurate and current.
12. Future Features
The Company may introduce additional Services from time to time, including but not limited to:
Hospital integrations.
Blood bank services.
AI-assisted health features.
Wearable device integration.
Government health platform integrations.
Additional Premium Services.
Such features may be governed by supplementary terms or policies where appropriate.
Continued use of newly introduced features may require acceptance of additional terms.
13. Premium Services
The Company may offer certain Services as paid subscriptions or one-time purchases ("Premium Services").
Premium Services may include enhanced features, additional functionality, expanded storage, priority support, or other benefits introduced by the Company from time to time.
Premium Services are optional and are not required to use the core emergency features of the App unless specifically stated.
The Company reserves the right to modify, introduce, discontinue, or replace Premium Services at its discretion.
Subscription & Billing
Premium Services may be offered through monthly, annual, or other subscription plans.
By purchasing a subscription, you authorize the applicable payment provider to process the payment in accordance with its terms and policies.
Subscription pricing, renewal terms, and applicable taxes will be displayed before purchase.
Renewal & Cancellation
Unless otherwise stated at the time of purchase:
Subscriptions may renew automatically through the respective app store or payment platform.
You may cancel future renewals at any time using the platform through which the subscription was purchased.
Cancellation does not automatically entitle you to a refund for the current billing period unless required by applicable law or the payment platform's policies.
Refunds
Refunds, where applicable, are governed by:
Google Play Billing policies;
Apple App Store policies (when applicable);
Razorpay payment terms (where applicable); and
Applicable laws.
The Company reserves the right to refuse refund requests that are inconsistent with these policies or applicable law.
14. Payments
Payments for Premium Services are processed through trusted third-party payment providers.
The Company does not store:
Credit card numbers;
Debit card numbers;
CVV;
UPI PINs;
Internet banking passwords; or
Other confidential payment credentials.
Payment information is processed directly by the applicable payment service provider.
Users should review the privacy policies and terms of the respective payment provider before completing any transaction.
15. Intellectual Property
All intellectual property rights relating to the Services remain the exclusive property of the Company or its licensors.
This includes, but is not limited to:
The 1st Alert name;
Logos;
Trademarks;
Software;
Source code;
Databases;
User interface designs;
Graphics;
Icons;
Text;
Documentation;
Website content;
Mobile application design;
Features;
Audio and visual materials.
Nothing contained in these Terms grants Users ownership of any intellectual property rights.
Users receive only a limited, non-exclusive, non-transferable, revocable license to use the Services in accordance with these Terms.
Restrictions
Users must not:
Copy or reproduce the Services except as permitted by law.
Reverse engineer, decompile, or disassemble the App.
Modify or create derivative works.
Sell, rent, sublicense, or commercially exploit the Services.
Remove copyright, trademark, or proprietary notices.
Attempt to bypass security mechanisms.
16. User Content
The Services allow Users to upload and store information, including:
Profile photographs;
Medical information;
Insurance documents;
Prescriptions;
Emergency Contacts;
Other content voluntarily submitted by the User.
Users retain ownership of the content they submit.
By uploading content, you grant the Company a limited, non-exclusive, royalty-free license to store, process, transmit, and display such content solely for the purpose of providing the Services.
The Company does not claim ownership of User Content.
Users are solely responsible for ensuring that uploaded content:
Is accurate;
Does not infringe the rights of others;
Does not violate applicable law; and
Does not contain malicious software.
17. Acceptable Use
Users agree to use the Services responsibly and lawfully.
Users must not:
Use the Services for unlawful purposes.
Create false or misleading emergency alerts.
Harass, threaten, or abuse other individuals.
Upload harmful or malicious software.
Attempt to gain unauthorized access to Company systems.
Interfere with the operation or security of the Services.
Impersonate another individual.
Use automated tools to access the Services without authorization.
Use the Services in any manner that could damage the reputation or operation of the Company.
The Company reserves the right to investigate suspected misuse and take appropriate action.
18. Suspension & Termination
The Company may suspend, restrict, or terminate access to the Services without prior notice where reasonably necessary to:
Protect the security or integrity of the Services;
Investigate suspected fraud or misuse;
Comply with applicable law;
Protect the rights or safety of Users or third parties; or
Enforce these Terms.
Examples include:
Providing false information;
Repeated misuse of emergency features;
Fraudulent activities;
Unauthorized access attempts;
Violation of these Terms.
Where appropriate, Users may be provided with an opportunity to resolve the issue before permanent termination.
Termination of an Account does not affect any rights or obligations that accrued before termination.
19. Service Availability
The Company continually strives to provide reliable Services but does not guarantee uninterrupted or error-free operation.
Service availability may be affected by factors beyond the Company's reasonable control, including:
Internet connectivity;
Mobile network availability;
GPS availability;
Device compatibility;
Battery status;
Operating system restrictions;
Scheduled maintenance;
Third-party service interruptions;
Natural disasters;
Power failures;
Government actions; or
Other force majeure events.
The Company may temporarily suspend the Services for maintenance, upgrades, or security improvements.
Reasonable efforts will be made to minimize disruption where practicable.
20. Limitation of Liability
To the maximum extent permitted by applicable law, the Company provides the Services on an "as available" and "as is" basis.
While we strive to provide reliable, secure, and high-quality Services, the Company does not warrant or guarantee that the Services will always be uninterrupted, error-free, or suitable for every situation.
The Company shall not be liable for any direct, indirect, incidental, special, consequential, exemplary, or punitive damages arising from or relating to:
Death, injury, or medical outcomes resulting from an emergency;
Delays in emergency response;
Failure of Emergency Contacts to receive, acknowledge, or respond to alerts;
Ambulance, police, hospital, or emergency service availability;
GPS inaccuracies or location errors;
Internet or mobile network interruptions;
Power failures or low device battery;
Device hardware or operating system failures;
Delayed, failed, or undelivered SMS, voice calls, push notifications, or conference calls;
User-provided information that is inaccurate, incomplete, or outdated;
Unauthorized access resulting from the User's failure to protect their account or device;
Temporary or permanent interruption of third-party services integrated with the App; or
Any circumstances beyond the Company's reasonable control.
Nothing in these Terms limits or excludes liability that cannot lawfully be excluded under applicable law.
21. Indemnification
You agree to indemnify, defend, and hold harmless First Alert Health Tech Private Limited, its directors, officers, employees, contractors, affiliates, licensors, and service providers from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable legal fees) arising out of or relating to:
Your use or misuse of the Services;
Your violation of these Terms;
Your violation of any applicable law;
Information or content submitted by you;
Your infringement of the rights of any third party.
This obligation survives termination of your Account or these Terms.
22. Third-Party Services
The Services rely on trusted third-party providers to deliver certain functionality.
These may include, but are not limited to:
Google Firebase
Google Play Services
MSG91
Exotel
100ms
Razorpay
These providers operate under their own terms and privacy policies.
The Company is not responsible for:
The availability of third-party services;
Changes made by third-party providers;
Service interruptions caused by third parties; or
Privacy practices of third-party providers.
Users should review the applicable terms and privacy policies of such providers where relevant.
23. Privacy
The Company's collection, use, storage, processing, and protection of personal information are governed by the 1st Alert Privacy Policy, which forms an integral part of these Terms.
By using the Services, you acknowledge that you have read and understood the Privacy Policy.
Where there is any inconsistency between these Terms and the Privacy Policy regarding the processing of personal information, the Privacy Policy shall govern matters relating to personal data.
24. Changes to these Terms
The Company may update these Terms from time to time to reflect:
Changes in applicable law;
New Services or features;
Improvements to existing Services;
Security enhancements;
Operational requirements.
The latest version of these Terms will always be made available through the App or the Company's official website.
Where required by law or where changes materially affect Users' rights, the Company will provide reasonable notice before such changes become effective.
Continued use of the Services after the effective date of revised Terms constitutes acceptance of those revised Terms, to the extent permitted by applicable law.
25. Governing Law & Jurisdiction
These Terms shall be governed by and construed in accordance with the laws of India.
Any dispute arising out of or relating to these Terms or the Services shall be subject to the exclusive jurisdiction of the competent courts located in Bengaluru, Karnataka, unless otherwise required by applicable law.
Before initiating legal proceedings, the parties agree to make reasonable efforts to resolve disputes through good-faith discussions.
26. Force Majeure
The Company shall not be liable for any delay, interruption, or failure to perform its obligations where such delay or failure results from events beyond its reasonable control.
Such events may include, but are not limited to:
Natural disasters;
Floods;
Earthquakes;
Fire;
War;
Civil unrest;
Terrorist acts;
Epidemics or pandemics;
Government actions;
Internet outages;
Mobile network failures;
Power failures;
Cybersecurity incidents affecting third-party infrastructure; or
Other events beyond the Company's reasonable control.
The Company will make reasonable efforts to restore affected Services as soon as practicable.
27. Severability
If any provision of these Terms is found to be invalid, unlawful, or unenforceable by a court of competent jurisdiction, that provision shall be enforced to the maximum extent permitted by law, and the remaining provisions shall remain in full force and effect.
28. Entire Agreement
These Terms, together with the Privacy Policy and any additional policies or guidelines expressly incorporated by reference, constitute the entire agreement between you and the Company regarding the Services.
These documents supersede all prior agreements, understandings, representations, or communications relating to the Services.
29. Electronic Acceptance
By creating an Account, accessing, or using the Services, you acknowledge that you have read, understood, and agree to be legally bound by these Terms.
You agree that your electronic acceptance of these Terms has the same legal effect as a handwritten signature, to the extent permitted under applicable law.
